Space Taxi Terms of service

By continuing to use the Space Taxi Application, you agree to be bound by these Terms and Conditions (T&Cs) for accessing and using the Application. You must read and understand the entire content before using any service offered by the Application, as all the terms and conditions herein are binding.

Space Taxi Limited reserves the right to modify these T&Cs or any other policies related to the platform at any time. By continuing to use the Application after any modifications, you agree to be bound by the revised terms and conditions from the effective date.

General Terms and Conditions

Space Taxi provides a platform that connects users of the platform with independent third-party transportation service providers, including independent third-party transportation providers.

SPACE TAXI LIMITED IS NOT A TRANSPORTATION, CARRIER, OR TAXI COMPANY. ALL SUCH SERVICES ARE PROVIDED BY INDEPENDENT THIRD-PARTY CONTRACTORS AND SERVICE PROVIDERS WHO ARE NOT EMPLOYED BY SPACE TAXI LIMITED.

GENERAL TERMS FOR DRIVERS OF SPACE TAXI (FOR PASSEGERS GENERAL TERMS PLEASE SCROLL DOWN)

These General Terms set forth the main terms and conditions applying to and governing the usage of the Space taxi Services. In order to provide Transportation Services via using the Space taxi Platform you must agree to the terms and conditions that are set forth below

DRIVER DOCUMENTS REQUIREMENTS AT SPACE TAXI APP IN KENYA 

Space Taxi drivers must provide the documents listed below to be considered for driving on the platform:

  • Passport photo
  • National ID
  • A valid Police Clearance Certificate from DCI
  • Driver’s regular driving license
  • Driver’s PSV License (Badge) issued by the NTSA (only for car drivers)
  • Vehicle Logbook/Sales Agreement
  • Vehicle’s NTSA Inspection sticker/report
  • Vehicle’s PSV insurance sticker.
  1. DEFINITIONS
    1. Space taxi Limited - (also referred to as “we”, “our” or “us”) – Space taxi Operations a private limited company incorporated and registered under the laws of Republic of Kenya with registration no PVT-RXU25K2J, registered office or other Space taxi group company.
    2. Space taxi Services – services that Space taxi provides, including provision and maintenance of Space taxi App, Space taxi Platform, In-app Payment, customer support, communication between the Driver and the Passenger and other similar services.
    3. Space taxi App – a smartphone application for Drivers and Passengers to request and receive Transportation Services
    4. Space taxi Platform – technology connecting Passengers with Drivers to help them move around cities more efficiently.
    5. Passenger – a person requesting Transportation Services by using Space taxi Platform.
    6. Driver (also referred to as „you “) – the person providing Transportation Services via the Space taxi Platform. Each Driver will get a personal Space taxi Driver Account to use Space taxi App and Space taxi Platform.
    7. Agreement – this agreement between Driver and Space taxi regarding the use of Space taxi Services which consists of these General Terms;
      1. special terms displayed in Space taxi App, e.g. regarding price info or service descriptions;
      2. the Drivers guidelines; and
      3. other terms referred to in this Agreement as may be amended from time to time.
    8. Service fees – the fee a Passenger is obliged to pay Driver for provision of the Transportation Services.
    9. Space Taxi subscription charge - is a fee paid by drivers to access the Space Taxi platform and receive ride requests for a specified period.
    10. In-app Payment – cards, carrier billing and other payment methods used by the Passenger via the Space taxi App to pay for the Transportation Services.
    11. Space taxi Driver Account – access to a website containing information and documents regarding usage of the Space taxi Services in course of provision of Transportation Services, including accounting documentation. Driver may access the Space taxi Driver Account at https://spacetaxi.ca By entering username and password.
    12. Tip-a gratuity offered by the Passenger at their sole discretion in addition to the Fare paid.
    13. Transportation Services – transport service a Driver is providing to Passenger whose request Driver has accepted through the Space taxi App.
  2. Account Creation and Terms of Use
    1. Registration: To use Space Taxi Services, you must create an account by providing the required information and documentation. You may register as an individual or a fleet company. Upon successful registration, Space Taxi will verify your account and send a notification via your phone number, email, or in-app notification. You can then log in using the phone number and password you provided during registration as your login details.

 

    1. Fleet Companies: Fleet companies may register accounts for their drivers or service providers. The fleet company will be responsible for ensuring that its drivers or service providers comply with these Terms of Service. The fleet company and its drivers or service providers will be jointly and severally liable for any violations.
    2. Representations and Warranties: By creating an account, you represent and warrant that:
      1. You are legally authorized to use Space Taxi Services.
      2. You have read, understood, and agree to be bound by these Terms of Service.
      3. All information provided is accurate and complete.
      4. You will maintain the accuracy of your account information.
      5. You will not share your account with others or transfer it to another person.
      6. You will not use Space Taxi Services for any unlawful or unauthorized purposes.
      7. You will comply with all applicable laws and regulations in republic of Kenya.
    3. Prohibited Activities: You may not:
      1. Decompile, reverse engineer, or modify the Space Taxi App or Account.
      2. Use modified versions of the Space Taxi App or Account.
      3. Transmit harmful or malicious content through the Space Taxi Platform.
      4. Attempt to gain unauthorized access to the Space Taxi Platform.
    4. Usage Agreement: Provided you comply with these Terms of Service, we grant you a limited, non-exclusive, non-transferable license to use the Space Taxi Driver Account. You are not permitted to sublicense or transfer these rights to third parties, except as allowed for fleet companies.
    5. Intellectual Property: All intellectual property rights in the Space Taxi Platform and related materials are owned by Space Taxi. Your use of the Platform does not grant you any ownership rights.

 

  1. Driver Responsibilities and Regulations
    1.  Professional Conduct: You are expected to provide Transportation Services in a professional, courteous, and safe manner. Specifically, you must:
      1. Prioritize Passenger Comfort: Choose the most efficient route unless directed otherwise by the Passenger.
      2. Avoid Unauthorized Stops: Refrain from making stops without the Passenger's consent.
      3. Transport Authorized Passengers Only: Carry only the Passenger and their authorized companions.
      4. Adhere to Traffic Laws: Comply with all traffic laws and regulations in the Republic of Kenya
    2. Required Licenses and Documentation: You must maintain all necessary licenses, permits, insurance, and documentation mandated by the jurisdiction where you operate. This includes a valid driver's license, business permits, vehicle insurance, and any other required documents. Space Taxi reserves the right to request and review proof of these at any time.
    3. Service Availability: You have the discretion to accept or decline ride requests. However, to ensure a positive experience for both drivers and passengers, you are expected to maintain a reasonable level of service availability and acceptance. While we understand that there may be times when you are unable to accept rides due to personal reasons or other commitments, excessive declines or long periods of inactivity may negatively impact your account activities.
    4. Service fees: You are entitled to a service fee for each completed service. The service fee is calculated based on a combination of factors, including:
      1. Distance traveled: The total distance of the trip, as measured by the Space Taxi app.
      2. Time elapsed: The duration of the trip, taking into account factors like traffic conditions and wait times.
      3. Minimum Charge: This is the base fare applied for the shortest distance, and it is included in every trip.
      4. Surge pricing: During periods of high demand or unfavorable conditions (e.g., inclement weather), a surge multiplier may be applied to the base service fee, resulting in a higher overall fee.
      5. Additional fees: There may be additional charges for services such as waiting time, toll fees or parking fee.

The specific service fee calculation method and any applicable surcharges or discounts will be clearly communicated to you through the Space Taxi app prior to accepting a ride.

    1. Service Fee Collection: Passengers may pay for the service fee either directly to you in cash or through the in-app payment option, where available. Details about the in-app payment process are outlined in Section 5 of these General Terms.
      1. Cash Payments: For rides paid in cash, you are responsible for collecting the full-service fee as indicated on the invoice. Passengers may also choose to provide a tip, which is entirely at their discretion. If a passenger fails or refuses to pay, Space Taxi will issue a debt notice on your behalf. However, Space Taxi is not obligated to cover any unpaid service fees.
      2. In-App Payments: For rides paid through the Space Taxi app, Space Taxi will collect the service fee on your behalf. These funds will be transferred to your Space Taxi driver wallet account. Please note that for in-app payment rides, you are not authorized to request any additional fees from passengers."
    2. Invoicing: Space Taxi will issue an itemized bill, or invoice, to the passenger for every completed ride. This invoice will provide a detailed summary of the trip, including the company's identification, the driver's name, vehicle details, the date and duration of the service, the exact locations of the pickup and drop-off points, the total distance covered, the amount charged, a breakdown of the fare components (such as time and distance-based charges), and any additional fees or tips applied. A digital copy of this invoice will be accessible to the driver through their Space Taxi account.
    3. Space Tax Responsibilities: Space Taxi Limited is responsible for calculating and remitting any taxes, including Value Added Tax (VAT), to the Kenyan government for using our platform. All payments made to Space Taxi Limited are inclusive of tax.
    4. Drivers Tax Responsibilities As a driver-partner, you are solely responsible for complying with all tax obligations related to your earnings. This includes, but not limited to, income tax, social security contributions, and any other applicable taxes. You must also ensure that you are registered for tax purposes and maintain accurate records for reporting and remitting taxes to the relevant authorities. Space Taxi may be required to disclose information about your earnings to tax authorities if legally obligated to do so.
  1. Repair or Cleaning Fees

If a passenger or their belongings cause damage to your vehicle, such as stains, odors, or physical damage, you may impose a cleaning or damage fee. If the cost of the damage exceeds the standard cleaning fee, you are entitled to pursue additional compensation through legal channels. Should the passenger refuse to pay, promptly report the incident to the relevant authorities and Space Taxi. We will assist in efforts to recover the costs; however, please note that Space Taxi is not responsible for any cleaning or repair expenses you may incur

  1. Payments
    1. Payment’s transactions: Space Taxi may offer passengers the option to pay for the service using various digital payment methods, such as credit cards or mobile wallets, directly through the Space Taxi app (In-App Payment). By agreeing to these terms, you authorize Space Taxi to collect and process these payments on your behalf. Once the passenger successfully completes the in-app payment, the transaction is considered finalized. You are required to accept all In-App Payment options and cannot influence the passenger's choice of payment method.
    2. In-App Payment Accuracy: Verify the passenger's identity to ensure you're providing the service to the correct individual. If someone unauthorized is using the passenger's account and an incorrect payment is processed, Space Taxi will reimburse the passenger, and you won't be compensated for the trip.
    3. Payment Management: You can access detailed reports of your in-app payment transactions within the Space Taxi driver app or account. These reports will provide all in-app payments processed. If you notice any discrepancies or errors in these reports, please notify Space Taxi immediately. If a passenger chooses to tip you directly through the Space Taxi app, the tip will be collected along with the service fee.
    4. Promotions: Space Taxi may offer promotional codes to passengers, which can be used to reduce the cost of a ride. These codes are subject to specific terms and conditions as determined by Space Taxi. Drivers are obligated to honor valid promotional codes when presented by passengers. The discount amount associated with the promo code will be deducted from the total fare and credited to your driver account. Promo codes can only be applied to in-app payments and are not valid for cash transactions.

 

  1. Payment Disputes
    1. Space Taxi is not liable for unpaid service fees resulting from failed in-app payments due to declined or canceled payment methods. In such cases, we will assist you in recovering the payment from the passenger. Once the passenger successfully completes the payment, we will transfer the funds to your driver wallet.
    2. Space Taxi reserves the right to withhold tips if there is evidence of fraud, abuse, or if the tip does not align with the intended purpose of a gratuity.
    3. If you have not provided or have entered incorrect bank or mobile money account details in your driver account, Space Taxi will be unable to process your payments. Please ensure your payment information is accurate and up-to-date to avoid delays in receiving your earnings.
    4. Space Taxi reserves the right to cancel or revoke any promotional code if it is suspected of being misused, fraudulently obtained, or used in violation of our terms and conditions. In such cases, the discount associated with the code will be forfeited.

 

  1. Space Taxi subscription charge
    1. Space Taxi subscription charge: To access and utilize the Space Taxi platform and its services, you must subscribe to our service by paying a fee, referred to as the Space Taxi subscription charge. The amount of this charge is determined by the chosen subscription duration. Payment of the subscription fee is required in advance before you can start using the platform.
    2. Subscription Fee Details: The specific amount of the Space Taxi subscription charge will be communicated to you through email, the Space Taxi website, your Space Taxi driver account, or other relevant channels. You may choose from various subscription options, each with its own corresponding charge.
    3. Upgrade: To upgrade your Space Taxi subscription plan, you can submit an application through the Space Taxi app or website at the end of your current subscription period. We may also provide additional methods for upgrading your subscription from time to time.
    4. Payment Terms: All payments required for the use of the Space Taxi platform or services are inclusive of all taxes and levies. Payments are due before or upon using our services. Payments can be made through the specified payment channels on the application.
    5. Cash back; Drivers will be given back 20% of their subscription fee whenever they subscribe to any package. The cash back fee will be paid directly to Drivers' wallet,and can access it anytime.
    6. Roll over;A Driver who pays subscription fee and fails to get  any ride request within the stipulated time of subscribed package,the subscription will be rolled over to the next period. i.e if a driver subscribe for 24hours and have not received  any ride request within that 24hours,He/She will be given Automatic subscription Extension for the next 24hours.
    1. Roll over  Policy
      1. Eligibility for a Roll over: You may be eligible for a roll over of your subscription time, if they meet the following criteria:
        1. No Rides Received: If you did not receive any ride requests during your active subscription period.
        2. No Rejected or Canceled Rides: If you did not reject more than 10 ride requests and did not cancel any accepted rides during the period without receiving any rides.
      2. Roll over Duration: If you meet the eligibility criteria, you may be eligible for a roll over of the new time for your subscription. For example, if you subscribed for half a day and met all the criteria, you may be eligible for another half a day.

 

  1. Platform Operator and Service Provider Relationship
    1. Our Role as a Technology Platform: Space Taxi is a technology platform that connects passengers with drivers to facilitate efficient city travel. We do not provide transportation services directly we offer lead generation. By using the Space Taxi platform, you are entering into a contract with passengers to provide transportation services independently or through a company. Space Taxi acts as a commercial agent, mediating the contracts between drivers and passengers and managing payments.
    2. No Employment Relationship: There is no employment relationship between you and Space Taxi. You are not an employee, agent, or representative of Space Taxi. You are not authorized to bind Space Taxi to any contracts or agreements. Any claims arising from an implied employment relationship are waived.
    3. Data Privacy and Access: Your personal data will be processed in accordance with our Privacy Notice. Space Taxi has access to all personal and other data provided or generated in connection with your use of the Space Taxi Services. We will take reasonable measures to ensure the confidentiality of this data and comply with applicable privacy laws. You have access to personal and other data provided by you or generated in connection with your use of the Space Taxi Services to the extent made available through your Space Taxi Driver Account. You are responsible for ensuring the confidentiality of this data and complying with applicable privacy laws.
    4. No Warranties: The Space Taxi platform is provided on an as it is. We make no representations or warranties regarding the uninterrupted, error-free, or secure operation of the platform. Due to the nature of ride-haling services, we cannot guarantee that your use of the platform will result in any ride requests. While we strive to maintain the highest standards of operation and reliability, technical issues or external factors may occasionally affect the platform's performance.
    5. Indemnification: You are responsible for any breach of these Terms of Service, the Agreement, or applicable laws and regulations. You must immediately stop and remedy any such breach upon receiving a demand from us or a relevant authority. You agree to indemnify and hold Space Taxi harmless from any direct or indirect loss, damage, loss of profits, expenses, penalties, or fines arising from your breach. If a passenger files a claim against Space Taxi due to your actions, you must compensate us for any damages or legal costs incurred.
    6. Passenger Liability: We are not responsible for the actions or omissions of passengers or co-passengers. You are solely responsible for any loss or damage you may incur due to their behavior.
    7. Limitation of Liability: To the fullest extent permitted by law, neither Space Taxi nor its representatives, directors, or employees shall be liable for any loss or damage arising from your use of the Space Taxi services. This includes, but is not limited to:
      1. Direct or indirect property damage or monetary loss
      2. Loss of profit or anticipated savings
      3. Loss of business, contracts, contacts, goodwill, reputation, or any loss arising from business interruption   
      4. Loss or inaccuracy of data
      5. Any other type of loss or damage
    8. Amendments to Terms of Service Space Taxi reserves the right to amend these General Terms at any time. We will provide at least five days' advance notice of any material amendments. However, we may amend the terms immediately if required to address unforeseen dangers, legal obligations, or security risks. If you do not agree to the amendments, you may terminate the Agreement by discontinuing your use of the Space Taxi services and providing notice. Continued use of the Space Taxi services after the effective date of the amendments constitutes your consent to be bound by the revised terms.
  2. FINAL PROVISIONS

If any provision of the General Terms is held to be unenforceable, the parties shall substitute for the affected provision an enforceable provision that approximates the intent and economic effect of the affected provision. Date of entry into force of the General Terms:

Space Taxi Limited Terms of Use for users 

    1. Introduction: These Terms of Use establish the rules and regulations governing your use of the Space Taxi app, a cutting-edge technology platform designed to facilitate efficient urban transportation by connecting passengers with reliable drivers. By utilizing the Space Taxi app, you acknowledge and agree to be bound by these terms. Space Taxi Limited, a privately held company established and registered under the laws of the Republic of Kenya, is the entity responsible for operating and maintaining the Space Taxi app. The terms.
    2. Your Agreement: By accessing or utilizing the Space Taxi app, you are expressly acknowledging and consenting to be bound by these Terms of Use. This signifies your agreement to abide by the rules and regulations governing your interaction with the Space Taxi platform. If you do not concur with these terms, you are advised to refrain from accessing or using the Space Taxi app.  
    3. Supplemental Terms: Additional terms and conditions may be applicable to specific features or services offered within the Space Taxi app. These supplemental terms, such as policies governing particular events or promotional activities, will be clearly disclosed to you in conjunction with the relevant features or services. It's important to note that these supplemental terms are considered an integral part of the overall Terms of Use. In the event of any inconsistencies or conflicts between the primary Terms of Use and these supplemental terms, the supplemental terms shall take precedence.
    4. Amendments: Space Taxi Limited reserves the right to modify or amend these Terms of Use from time to time. Any such changes or updates will be implemented at the discretion of Space Taxi Limited. The amended Terms will become effective upon their publication on the Space Taxi app. Your continued utilization of the Space Taxi app subsequent to the posting of amended Terms constitutes your explicit consent to be bound by these revised guidelines.
    5. Technology Platform: The Space Taxi app serves as a cutting-edge technological platform designed to facilitate the efficient arrangement and scheduling of transportation services by connecting users with a network of independent third-party drivers. It's important to note that Space Taxi Limited does not directly provide transportation services. Instead, the transportation services are exclusively offered by independent contractors who operate autonomously and are not considered employees of Space Taxi Limited.
    6.  Grantee of use: Provided that you adhere to and comply with all terms and conditions outlined in these Terms of Use, Space Taxi Limited extends to you a restricted, non-exclusive, non-transferable, and revocable license to access and utilize the Space Taxi app. This is exclusively intended for your personal, non-commercial use and does not grant you any ownership rights or entitlements to the Space Taxi app or its underlying technology
    7. Restrictions You are strictly prohibited from removing, altering, or concealing any proprietary information displayed within the Space Taxi app. Additionally, you are not permitted to duplicate, modify, or distribute the Space Taxi app or its content without obtaining prior written consent from Space Taxi Limited. Furthermore, you are forbidden from analyzing the app's source code or structure to reverse engineer or decompile it. Any attempt to link, mirror, or frame any portion of the Space Taxi app within another website or application is strictly prohibited. Lastly, you are not allowed to extract, organize, or analyze data from the Space Taxi app for any purpose without explicit permission.
    8. Third-Party Services: The Space Taxi app may be utilized in conjunction with or accessed through various third-party services and content, including advertising materials. It's important to note that Space Taxi Limited does not endorse or sponsor these third-party services and content. Consequently, Space Taxi Limited bears no responsibility or liability for any products or services offered by these third-party providers.
    9. Ownership: The Space Taxi app, including all of its intellectual property rights, shall remain the exclusive property of Space Taxi Limited. This encompasses all aspects of the app, from its underlying technology and design to its content and features. Space Taxi Limited retains complete ownership and control over the Space Taxi app and any associated rights.
    10. Using the Space Taxi App: When utilizing the Space Taxi app, passengers establish a contractual agreement with drivers for the provision of transportation services. This contractual relationship is formed through the Space Taxi platform. Payments for these transportation services can be conveniently made using either cash or the Space Taxi App Payment system. It's important to note that passengers' mobile numbers are securely linked to their respective Space Taxi user accounts and stored within Space Taxi Limited's database.
  1. Ordering a Transport Service:
    1. When you request a ride on Space Taxi, you're initiating a connection with a driver who has agreed to provide the service. This agreement is separate from your relationship with Space Taxi itself. Once a driver confirms your ride, you enter into a direct agreement with them for the specific journey, subject to the terms you and the driver agree upon.
    2. Canceling a Transport Service: If you cancel a confirmed ride multiple times within a 24-hour period, Space Taxi may temporarily block your account as a warning. Repeated offenses could lead to longer suspensions or even permanent account closure. Additionally, if a driver arrives at your pickup location, but you don't arrive within a specified time, the ride may be considered canceled. In such cases, you might be charged a waiting fee.
    3. Damages and Penalties: If you cause damage to the driver's vehicle, you may be liable for a penalty or compensation. Space Taxi may pursue these claims on behalf of the transportation service provider if you fail to pay

 

  1. Payment Methods and Processing
    1. Available Options: At your discretion, you have the flexibility to choose from a variety of payment methods to settle the cost of transportation services. These options include convenient methods like credit or debit cards, mobile carrier billing, or Space Taxi Business payments, which may be subject to availability based on your specific location. Additionally, for added convenience, you may also opt for traditional cash payments. All of these payment options can be easily accessed and utilized through the user-friendly Space Taxi app
    2. Space Taxi as Commercial Agent: When you opt to utilize the Space Taxi App Payment feature, Space Taxi Limited assumes the role of a commercial agent representing the transportation service providers. This means that each driver has granted Space Taxi Limited the authority to act as an intermediary in negotiating and facilitating contracts between themselves and passengers. This includes the power to accept payments from passengers on behalf of the drivers and subsequently forward these payments to the respective drivers.
    3. Payment Completion: Your contractual obligation to the driver is considered fulfilled once you initiate a payment order to transfer funds to Space Taxi Limited's designated bank account. It is your responsibility to ensure that the payment process is completed successfully and that there are sufficient funds available in your account to cover the transaction. Any payment failures or insufficient funds may result in delays or cancellations of the transportation service.
  2. Space Taxi App Payment:
    1. Tipping: You can choose to tip the driver through Space Taxi In-App Payment using authorized methods. Space Taxi does not take any commission on the tip amount, and the full amount (excluding applicable taxes) is transferred to the driver. However, Space Taxi reserves the right to withhold the tip if it's suspected to be fraudulent, illegal, unrelated to the service, or violates Space Taxi's Terms and Conditions.
    2. Payment Processing: Space Taxi Limited acts as a payment processor for app transactions. When you utilize Space Taxi App Payment, the company receives your payment and subsequently forwards it to the driver. To ensure the security and integrity of your payment, Space Taxi Limited may request additional verification information regarding your chosen payment method. This verification process is implemented to safeguard against potentially fraudulent activities and to validate the authenticity of your payment.
    3. Third-Party Payment Fees: Space Taxi Limited is not liable for any additional charges that may be imposed by third-party payment providers, such as mobile network operators or financial institutions, when utilizing in-app payment methods. These fees are distinct from the primary service cost and are the sole responsibility of the payment method provider you have selected. It is highly recommended that users carefully review the terms and conditions associated with their chosen payment method to gain a comprehensive understanding of any potential fees or charges that may apply.
    4. Space Taxi's Role and Support: Space Taxi Limited takes full responsibility for ensuring the smooth operation and functionality of the Space Taxi In-App Payment system. This commitment extends to providing comprehensive support for users encountering any issues or problems related to in-app payments. Should you experience any difficulties while using this feature, Space Taxi Limited is dedicated to assisting you in resolving the matter efficiently. You can conveniently reach out to our dedicated support team via email at support@spacetaxi.ca. For your peace of mind, Space Taxi Limited assures you that all emails and inquiries submitted through the Space Taxi app will receive a response within one business day. Furthermore, for any payment-related complaints, Space Taxi Limited pledges to diligently investigate and address the issue within a timeframe of two business days.
    5. Fares: You may be presented with an option to agree to a fixed service charge for a specific transportation service provided by the Driver. This upfront service charge will be clearly communicated to you via the Space Taxi app prior to requesting the ride. It's important to note that the upfront service charge may not apply if you modify your destination during the ride, if the ride experiences significant delays due to traffic or other factors, or if unforeseen circumstances materially impact the ride's characteristics, such as encountering tolls on a different route.
  3. Passenger Responsibility and Personal Belongings
    1. Passenger Liability for Vehicle Damage and Cleaning - You shall be responsible for the costs associated with repairing or cleaning any damage caused to Third Party Provider vehicles or property as a result of your use of the Space Taxi app, beyond the scope of typical wear and tear. In instances where a Third-Party Provider reports the need for repairs or cleaning, and such reports are verified by Space Taxi Limited through reasonable assessment, Space Taxi Limited reserves the right to facilitate payment for the necessary costs on your behalf. These payments will be transferred to the applicable Third-Party Provider and are non-refundable.
    2. As a passenger, you bear full responsibility for ensuring that all personal belongings are removed from the vehicle before disembarking. Should you inadvertently leave items behind, the Third-Party Provider may attempt to return them to you, Space Taxi Limited, or the local Space Taxi service entity. However, Space Taxi Limited cannot be held accountable if the Third-Party Provider fails to return your belongings as expected. Additionally, Space Taxi Limited is not liable for any loss or damage to your property during transit.
    3. If your belongings are returned to Space Taxi Limited's offices, we will make diligent efforts to identify and contact the rightful owner. However, please be aware that Space Taxi Limited will only retain your property for a maximum of three months from the date it is received. If you fail to claim your belongings within this timeframe, Space Taxi Limited reserves the right to dispose of them as deemed appropriate. In such cases, you will forfeit any claim against Space Taxi Limited for unclaimed property.
  4. Space Taxi's Role as a Platform

Space Taxi is a technology platform that connects riders with transportation service providers. It's important to understand that Space Taxi itself does not provide the transportation services. This means that any issues related to the quality of the ride, such as vehicle condition, driver behavior, or route taken, should be addressed directly with the driver or the transportation company they represent.

  1. User Feedback and Accountability

Space Taxi encourages users to provide feedback within the app. This feedback helps to identify areas where drivers can improve their service. However, it's essential to note that the ultimate responsibility for resolving issues lies with the transportation service provider or the relevant regulatory authorities.

 

  1. Account Termination

Space Taxi reserves the right to terminate user accounts if they violate the platform's terms of service or engage in malicious behavior. This includes actions such as withholding payment, fraud, or disrespecting drivers. In such cases, Space Taxi may take action without prior notice.

 

  1. Driver Screening and Quality Assurance

Space Taxi makes efforts to ensure that only reputable and respectful drivers use their platform. However, they cannot guarantee the behavior of every driver at all times. If you encounter a negative experience, you should report it to the transportation company, a regulatory authority, or Space Taxi's customer support.

 

  1. Amendments to Terms

Space Taxi reserves the right to modify its General Terms and Conditions. If significant changes are made, you'll be notified via email or through the Space Taxi app. Continued use of the app after such notifications indicates your acceptance of the amended terms.

 

 

  1. Governing Law and Dispute Resolution

The General Terms and Conditions are subject to the laws of the Republic of Kenya. In the event of a dispute arising from these terms or your agreement with a driver, both parties will attempt to resolve the issue through negotiation. If negotiations fail, the dispute will be settled in a Kenyan court.

  1. Severability

If any part of the General Terms and Conditions is found to be unenforceable, the remaining provisions will remain in effect. Space Taxi will strive to replace the unenforceable provision with a similar one that aligns with the original intent and purpose.

 

 

 

 

Space Taxi Limited Deactivation Policy

Space Taxi Limited is dedicated to providing a safe, reliable, and high-quality platform for both passengers and drivers. To ensure the integrity of our platform, we have implemented the following deactivation policy, which outlines the circumstances under which a driver may be removed from the Space Taxi platform.

  1. Deactivation reasons
    1. Safety Violations: Drivers who engage in any of the following safety violations may face deactivation:
    1. Reckless Driving: Driving in a manner that endangers passengers or other road users, such as speeding, tailgating, or aggressive driving.
    2. Traffic Law Violations: Failing to comply with traffic laws and regulations, including but not limited to speeding, running red lights, or driving under the influence.
    3. Passenger Safety Compromises: Any actions that compromise passenger safety, such as driving while distracted, failing to maintain a clean and safe vehicle, or engaging in inappropriate behavior
    1. Inappropriate Behavior: Drivers are expected to conduct themselves professionally and respectfully at all times. Any instances of inappropriate behavior, including harassment or discrimination towards passengers, fellow drivers, or Space Taxi staff, will be considered a serious violation and may result in deactivation.
    2. Low Ratings: Drivers who consistently receive low ratings from passengers may be subject to deactivation after a thorough investigation. Space Taxi Limited regularly reviews driver ratings to maintain a high-quality experience for all users.
    3. Failure to Meet Eligibility Criteria: Drivers must meet and maintain all eligibility requirements set by Space Taxi Limited. This includes, but is not limited to, holding a valid driver's license, valid passage service vehicle budge, and insurance. Failure to meet these criteria may result in deactivation.
  1. Deactivation Process
    1. Organization drivers’ involvement: Before deactivating a driver's account, we understand the potential financial implications and damages that may occur. However, to ensure the integrity of our platform and the safety of our passengers, we have implemented a review process that includes input from a driver's organization representative. A joint Space Taxi-Driver Organization Deactivation Board will be responsible for reviewing cases and making recommendations.
    2. Investigations: Space Taxi-Driver Organization Deactivation Board will conduct a thorough investigation into any reported incidents or violations of our terms of service. This may involve collecting information from passengers, involved parties or reviewing relevant data
    3. Notification: If Space Taxi-Driver Organization Deactivation Board determines that deactivation is necessary, the driver will be notified through the Space Taxi platform or other designated communication channels. The notification will provide detailed information regarding the reason for the deactivation and any potential steps the driver can take to address the issue.
    4. Right to Appeal: Drivers who are deactivated have the right to appeal the decision. If you believe your deactivation was unfair or a mistake, you can submit an appeal within 21 days of receiving the deactivation notification. Appeals should be submitted through Space Taxi support at support@spacetaxi.ca . We recommend including any relevant information that may help us review your case, such as details about the incident, evidence to support your position, or a written explanation of the events. We take appeals seriously and will conduct a thorough review of all submitted information. You will be notified of the outcome of your appeal through the same communication channels used for the deactivation notification.
    5. Appeals Review and Resolution: All appeals will be reviewed by the Space Taxi-Driver Organization Deactivation Board. The board will carefully consider the evidence and arguments presented in your appeal. The decision of the Deactivation Review Board is final and binding.
    6. Periodic Reviews: Space Taxi-Driver Organization Deactivation Board will conduct regularly reviews on driver performance to ensure the highest standards of service. Based on historical or recent performance data, we may deactivate drivers who consistently fail to meet our expectations or who pose a risk to the safety and satisfaction of our passengers.
    7. Reactivation: Drivers who have been deactivated may be eligible for reactivation after addressing and resolving the underlying issues that led to the deactivation. The specific requirements and procedures for reactivation will be communicated to the driver at the time of deactivation. Please note that reactivation is not guaranteed, and drivers must demonstrate that they have taken appropriate steps to rectify the issues and are committed to providing a safe and reliable service.
  2. Policy Updates

Space Taxi Limited reserves the right to update or modify this deactivation policy at any time. Any changes to the policy will be communicated to all drivers through the Space Taxi platform or other designated channels. It is important for drivers to review the policy regularly to ensure they are aware of any updates. Space Taxi Limited is committed to being a responsible company in Kenya. As such, we may not process any account where the owner is involved in legal proceedings or under investigation by government agencies related to activities conducted through our platform.

3.2 Professional Appearance: Present a clean and professional appearance while providing services as a Space Taxi Limited driver.

3.3 Vehicle Maintenance: Ensure that the assigned vehicle is well-maintained and complies with all safety and regulatory requirements. Conduct regular inspections and address any maintenance issues promptly.

Section 4: Vehicle Owner Conduct

4.1 Compliance with Agreements: Comply with all agreements and contracts with Space Taxi Limited, including vehicle use and maintenance agreements.

4.2 Vehicle Inspection: Regularly inspect and maintain your vehicle to ensure it meets all safety standards. Address any maintenance issues promptly.

Section 5: Reporting Violations

5.1 Reporting Procedures: Employees, drivers, and vehicle owners are encouraged to report any violations of this Code of Conduct promptly. If you witness or experience any inappropriate behavior, please report it to your supervisor or directly to Space Taxi Limited.

5.2 Non-Retaliation: Space Taxi Limited prohibits retaliation against individuals who report violations of this Code of Conduct in good faith. Any reports of retaliation will be taken seriously and investigated.

  2. Wajibu na Kanuni za Dereva
    1. Maadili ya Kitaalamu: Unatarajiwa kutoa Huduma za Usafiri kwa njia ya kitaalamu, adabu na salama. Hasa, lazima:
      1. Tanguliza Kustarehe kwa Abiria: Chagua njia bora zaidi isipokuwa uelekezwe vinginevyo na Abiria.

Iwapo utaacha vitu bila kukusudia, Mtoa Huduma wa Mtu wa Tatu anaweza kujaribu kuvirejesha kwako, Space Taxi Limited, au huluki ya huduma ya Space Taxi. Hata hivyo, Space Taxi Limited haiwezi kuwajibika ikiwa Mtoa Huduma wa Mtu Wa Tatu atashindwa kurejesha mali yako kama inavyotarajiwa. Zaidi ya hayo, Space Taxi Limited haiwajibikiwi kwa hasara au uharibifu wowote wa mali yako wakati wa usafiri.

5.3. Ikiwa mali zako zitarejeshwa kwa ofisi za Space Taxi Limited, tutafanya juhudi za dhati kutambua na kuwasiliana na mmiliki halali. Hata hivyo, tafadhali fahamu kuwa Space Taxi Limited itahifadhi mali yako kwa muda usiozidi miezi mitatu kuanzia tarehe itakapopokelewa. Iwapo utashindwa kudai mali yako ndani ya muda huu, Space Taxi Limited inahifadhi haki ya kuzitupa kama inavyoonekana inafaa. Katika hali kama hizi, utapoteza dai lolote dhidi ya Space Taxi Limited kwa mali ambayo haijadaiwa.

10.Marekebisho ya Masharti

Teksi ya Nafasi inahifadhi haki ya kurekebisha Masharti na Masharti yake ya Jumla. Ikiwa mabadiliko makubwa yatafanywa, utaarifiwa kupitia barua pepe au kupitia programu ya Teksi ya Nafasi. Kuendelea kutumia programu baada ya arifa kama hizo kuonyesha kukubali kwako masharti yaliyorekebishwa.

11.Sheria inayoongoza na Utatuzi wa Migogoro

Masharti na Masharti ya Jumla yako chini ya sheria za Jamhuri ya Kenya. Katika tukio la mzozo unaotokana na masharti haya au makubaliano yako na dereva, pande zote mbili zitajaribu kutatua suala hilo kupitia mazungumzo. Ikiwa mazungumzo yatashindwa, mzozo huo utatatuliwa katika mahakama ya Kenya.

12.Mseto

Ikiwa sehemu yoyote ya Masharti na Masharti ya Jumla itapatikana kuwa haiwezi kutekelezeka, masharti yaliyosalia yataendelea kutumika. Teksi ya Nafasi itajitahidi kubadilisha utoaji usiotekelezeka na ule unaofanana na unaolingana na dhamira na madhumuni asili.

1.Sababu za kuzima

1.1. Ukiukaji wa Usalama: Madereva wanaojihusisha na ukiukaji wowote wa usalama ufuatao wanaweza kukabiliwa na kuzimwa:

a. Kuendesha gari bila kujali: Kuendesha gari kwa njia inayohatarisha abiria au watumiaji wengine wa barabara, kama vile mwendo kasi, kushika mkia au kuendesha gari kwa fujo.

b. Ukiukaji wa Sheria ya Trafiki: Kukosa kutii sheria na kanuni za trafiki, ikijumuisha lakini sio tu kwa mwendo kasi, kuendesha taa nyekundu, au kuendesha gari ukiwa umeathiriwa.

c.Maelewano ya Usalama wa Abiria: Vitendo vyovyote vinavyohatarisha usalama wa abiria, kama vile kuendesha gari ukiwa umekengeushwa, kushindwa kudumisha gari safi na salama, au kujihusisha na tabia isiyofaa

1.2. Tabia Isiyofaa: Madereva wanatarajiwa kujiendesha kitaaluma na heshima wakati wote. Matukio yoyote ya tabia isiyofaa, ikiwa ni pamoja na unyanyasaji au ubaguzi kwa abiria, madereva wenzao, au wafanyakazi wa Space Taxi, yatachukuliwa kuwa ukiukaji mkubwa na yanaweza kusababisha kuzimwa.

1.3. Ukadiriaji wa Chini: Madereva ambao mara kwa mara hupokea ukadiriaji wa chini kutoka kwa abiria wanaweza kuzimwa baada ya uchunguzi wa kina. Space Taxi Limited hukagua mara kwa mara ukadiriaji wa madereva ili kudumisha hali ya matumizi ya ubora wa juu kwa watumiaji wote.

1.4. Kushindwa Kukidhi Vigezo vya Kustahiki: Ni lazima Madereva watimize na kudumisha mahitaji yote ya ustahiki yaliyowekwa na Space Taxi Limited. Hii ni pamoja na, lakini sio tu, kushikilia leseni halali ya udereva, budge halali ya gari la huduma, na bima. Kukosa kukidhi vigezo hivi kunaweza kusababisha kuzimwa.

2.Mchakato wa Kuzima

2.1. Ushiriki wa madereva wa shirika: Kabla ya kuzima akaunti ya dereva, tunaelewa athari za kifedha zinazoweza kutokea na uharibifu unaoweza kutokea. Hata hivyo, ili kuhakikisha uadilifu wa jukwaa letu na usalama wa abiria wetu, tumetekeleza mchakato wa ukaguzi unaojumuisha maoni kutoka kwa mwakilishi wa shirika la udereva. Space Taxi-Driver Organization Deactivation Board itakuwa na jukumu la kukagua kesi na kutoa mapendekezo.

2.2. Uchunguzi: Space Taxi-Driver Organization Deactivation Board itafanya uchunguzi wa kina kuhusu matukio yoyote yaliyoripotiwa au ukiukaji wa sheria na masharti yetu. Hii inaweza kuhusisha kukusanya taarifa kutoka kwa abiria, wahusika au kukagua data husika.

2.4. Haki ya Rufaa: Madereva ambao wamezimwa wana haki ya kukata rufaa dhidi ya uamuzi huo. Ikiwa unaamini kuwa kuzima kwako hakukuwa kwa haki au kosa, unaweza kuwasilisha rufaa ndani ya siku 21 baada ya kupokea arifa ya kuzima. Rufaa zinapaswa kuwasilishwa kupitia usaidizi wa Space Taxi  kwa support@spacetaxi.ca . Tunapendekeza kujumuisha maelezo yoyote muhimu ambayo yanaweza kutusaidia kukagua kesi yako, kama vile maelezo kuhusu tukio, ushahidi wa kuunga mkono msimamo wako, au maelezo ya maandishi ya matukio. Tunachukua rufaa kwa uzito na tutafanya mapitio ya kina ya taarifa zote zilizowasilishwa. Kulingana na data ya utendakazi ya kihistoria au ya hivi majuzi, tunaweza kuzima madereva ambao mara kwa mara hushindwa kukidhi matarajio yetu au wanaohatarisha usalama na kuridhika kwa abiria wetu.

2.7. Uanzishaji upya: Madereva ambao wamezimwa wanaweza kustahiki kuwashwa tena baada ya kushughulikia na kutatua masuala ya msingi yaliyosababisha kuzimwa. Mahitaji na taratibu mahususi za kuwezesha upya zitawasilishwa kwa dereva wakati wa kuzima. Tafadhali kumbuka kuwa uanzishaji upya haujahakikishwa, na madereva lazima waonyeshe kuwa wamechukua hatua zinazofaa kurekebisha masuala na wamejitolea kutoa huduma salama na ya kuaminika.

                                       3.Masasisho ya Sera

Space Taxi Limited inahifadhi haki ya kusasisha au kurekebisha sera hii ya kuzima wakati wowote. Mabadiliko yoyote kwenye sera yatawasilishwa kwa madereva wote kupitia jukwaa la Space Taxi Platform au vituo vingine vilivyoteuliwa. Ni muhimu kwa madereva kukagua sera mara kwa mara ili kuhakikisha kuwa wanafahamu masasisho yoyote. Space Taxi Limited imejitolea kuwa kampuni inayowajibika nchini Kenya. Kwa hivyo, hatuwezi kuchakata akaunti yoyote ambapo mmiliki anahusika katika kesi za kisheria au anachunguzwa na mashirika ya serikali kuhusiana na shughuli zinazofanywa kupitia jukwaa letu.

1.1 Heshima na Utaalam: Watu wote wanaohusishwa na Space Taxi Limited, ikiwa ni pamoja na wafanyakazi, madereva, na wamiliki wa magari, wanatarajiwa kutendeana, wateja na umma kwa heshima, adabu na taaluma wakati wote.

1.2 Uadilifu na Uaminifu: Dumisha viwango vya juu zaidi vya uadilifu na uaminifu katika mwingiliano wote. Kuwa wazi na ukweli katika shughuli zako na wengine.

1.3 Kuzingatia Sheria: Kuzingatia sheria na kanuni zote zinazotumika za ndani, kikanda na kitaifa zinazohusiana na huduma za usafiri.

2.1 Usiri: Linda na udumishe usiri wa taarifa za kampuni na mteja. Usishiriki taarifa nyeti na watu ambao hawajaidhinishwa.

2.2 Tabia ya Mahali pa Kazi: Unda mazingira chanya na jumuishi ya kazi bila ubaguzi, unyanyasaji na kulipiza kisasi. Watendee wenzako wote kwa heshima na waepuke aina yoyote ya uonevu au tabia isiyofaa.

2.3 Matumizi ya Rasilimali za Kampuni: Tumia rasilimali za kampuni kwa uwajibikaji na kwa madhumuni yanayohusiana na kazi pekee. Usitumie vibaya mali au teknolojia ya kampuni.

5.2 Kutolipiza kisasi: Space Taxi Limited inakataza kulipiza kisasi dhidi ya watu wanaoripoti ukiukaji wa Kanuni hii ya Maadili kwa nia njema. Ripoti zozote za kulipiza kisasi zitachukuliwa kwa uzito na kuchunguzwa
